Why mediate your divorce?

On Behalf of | Jun 13, 2022 | Divorce

If you are dreading the thought of your divorce, it is important to realize that it does not need to be a horror show. You do not need to spend weeks in court bringing up every little thing your spouse once did in an attempt to get the settlement you need.

Mediation is a much more pleasant way to handle things than litigation. It can help you end your marriage on good terms, which is especially crucial if you share children, work together, hang out with the same crowd, or intend to carry on living close to each other.

Being quicker, mediation can also save you both a lot of money.

How does mediation work?

It involves a trained third party. Their job is to stay neutral and help you and your legal team reach compromises with your spouse and their legal team. You make the decisions about your future, rather than having a judge tell you what will happen.

Are there any occasions where you should avoid mediation?

You should be able to handle most divorces this way, provided you have the right legal support. Possible reasons to avoid it are if you fear your spouse will be able to manipulate you too easily when you are in the room together or if you feel fearful in their presence due to previous abuse. In those cases, it may be better to litigate.

What if mediation does not work?

If you cannot resolve the issues this way, then you retain the option to revert to litigation. Yet when you both enter committed to the mediation process, the chances are high that you will solve things. Find out more to see if you can mediate your divorce.
